General Terms and Conditions

These General Terms and Conditions apply to all offers, orders and agreements between Koning Bamboe and its customers.

Article 1 – Definitions

In these General Terms and Conditions:

• Entrepreneur: Koning Bamboe, the party offering products to consumers.
• Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession.
• Agreement: the agreement between the consumer and the entrepreneur concerning the purchase of one or more products.
• Distance agreement: an agreement concluded between the entrepreneur and the consumer within the framework of an organised distance sales system, without the simultaneous physical presence of the entrepreneur and the consumer.
• Right of withdrawal: the consumer's right to withdraw from the distance agreement within the applicable withdrawal period.
• Working day: a day other than a Saturday, Sunday or public holiday in the Netherlands.

Article 3 – Applicability

These General Terms and Conditions apply to every offer made by Koning Bamboe and to every agreement concluded with a consumer.

Before the agreement is concluded, these General Terms and Conditions are made available to the consumer in such a way that they can be stored by the consumer on a durable medium.

If specific product or service conditions apply in addition to these General Terms and Conditions, the consumer may rely on the provision that is most favourable to them in the event of conflicting provisions.

Article 4 – The Offer

If an offer has a limited period of validity or is subject to conditions, this will be clearly stated in the offer.

The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow the consumer to properly assess the products.

Images, photographs and other visual materials are intended to provide an accurate impression of the products. Minor differences in colour, texture or appearance may occur, particularly with natural materials such as bamboo.

Obvious errors or mistakes in the offer do not bind Koning Bamboe.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and fulfils the applicable conditions.

If the consumer accepts the offer electronically, Koning Bamboe will confirm receipt of the acceptance electronically.

Koning Bamboe will take appropriate technical and organisational measures to protect the electronic transfer of data and will ensure a secure web environment where applicable.

Koning Bamboe may, within the limits of applicable law, verify whether the consumer can meet their payment obligations before accepting an order.

Article 6 – Prices and Payment

The prices displayed on the website include VAT, unless explicitly stated otherwise.

Any additional costs, such as delivery costs, will be clearly communicated before the order is placed.

The consumer must pay using one of the payment methods offered during the ordering process.

If payment is not made on time, Koning Bamboe may, subject to applicable law, suspend or cancel the order after giving the consumer the required opportunity to fulfil their payment obligation.

Article 7 – Delivery and Delivery Time

Koning Bamboe will take the greatest possible care when receiving and processing orders and when fulfilling orders for products.

The place of delivery is the address provided by the consumer during the ordering process.

Koning Bamboe will endeavour to deliver accepted orders within the stated delivery period.

If a product cannot be delivered within the agreed delivery period, the consumer will be informed as soon as possible.

Unless otherwise agreed, delivery will take place no later than 30 days after the order has been placed. If delivery is delayed beyond this period, the consumer has the right to cancel the agreement in accordance with applicable law, unless a different delivery period has been expressly agreed.

The risk of damage to or loss of the products passes to the consumer when the consumer, or a third party designated by the consumer, has physically received the products, unless otherwise provided by mandatory law.

Article 8 – Right of Withdrawal

When purchasing products online, the consumer generally has the right to withdraw from the agreement without giving any reason within 14 days.

The withdrawal period starts on the day after the consumer, or a third party designated by the consumer, has received the product.

The consumer may exercise the right of withdrawal by informing Koning Bamboe within the withdrawal period using an unambiguous statement.

The consumer may use the model withdrawal form available on the website, but is not required to do so.

After notifying Koning Bamboe of the withdrawal, the consumer must return the product without undue delay and in any event no later than 14 days after the day on which the consumer communicated the withdrawal.

Article 9 – Returns and Refunds

Products must be returned, where reasonably possible, in their original condition and packaging, together with all accessories and documentation supplied with the product.

The consumer is only liable for any diminished value of the product resulting from handling that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.

After receiving a valid withdrawal notification, Koning Bamboe will refund the amounts paid by the consumer, including the standard delivery costs charged for the original shipment, in accordance with applicable law.

Koning Bamboe may wait with the refund until the products have been received back or until the consumer provides proof that the products have been returned, whichever occurs first.

Return shipping is free for returns from all countries, in accordance with the current return policy published on the website.

Article 10 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in situations where the law provides for an exception.

This may include, for example, products that are manufactured according to the consumer's specifications or that are clearly personalised, where the statutory requirements for such an exception are met.

If an exception to the right of withdrawal applies to a particular product, this will be clearly stated before the purchase is concluded.

Article 11 – Legal Guarantee and Conformity

The consumer is entitled to the statutory rights concerning conformity of the product.

A product must comply with the agreement and must possess the characteristics that the consumer may reasonably expect based on the nature of the product, the information provided and the circumstances surrounding the purchase.

Natural materials such as bamboo may show differences in colour, grain, texture or structure. Such natural characteristics do not automatically constitute a defect if they are consistent with the nature of the product and the information provided before purchase.

The statutory rights of the consumer remain unaffected by any commercial warranty or additional warranty offered by Koning Bamboe.

Article 12 – Additional Warranty

If Koning Bamboe offers an additional commercial warranty for a particular product, the applicable conditions will be stated clearly with the product or on the website.

An additional warranty does not limit the consumer's statutory rights and claims relating to conformity.

Article 13 – Complaints

Koning Bamboe aims to handle complaints carefully and efficiently.

Complaints concerning the performance of an agreement should be submitted to Koning Bamboe as soon as reasonably possible after the consumer has identified the issue.

A complaint can be submitted by e-mail to [email protected]. Please include the order number and a clear description of the complaint where possible.

Koning Bamboe will respond to complaints as soon as reasonably possible and will endeavour to provide a substantive response within 14 days of receipt.

If a complaint requires more time to investigate, Koning Bamboe will inform the consumer and indicate when a more detailed response can be expected.

Article 14 – Liability

Nothing in these General Terms and Conditions limits the consumer's statutory rights or excludes liability where such exclusion or limitation is not permitted by law.

Koning Bamboe is not liable for damage resulting from improper use of products, use contrary to the instructions provided, or circumstances for which Koning Bamboe is not legally responsible.

This article does not affect mandatory statutory provisions concerning product liability or consumer protection.

Article 15 – Force Majeure

Koning Bamboe is not obliged to fulfil an obligation if it is prevented from doing so as a result of circumstances beyond its reasonable control.

Force majeure may include circumstances such as disruptions in transport, strikes, fire, natural disasters, government measures, serious technical failures or disruptions affecting suppliers or logistics partners, insofar as these circumstances cannot reasonably be attributed to Koning Bamboe.

If a force majeure situation lasts for an extended period and fulfilment is no longer reasonably possible, both parties may have rights to terminate the agreement in accordance with applicable law.

Article 16 – Intellectual Property

All intellectual property rights relating to texts, photographs, images, logos, designs and other content published on the Koning Bamboe website belong to Koning Bamboe or its licensors, unless stated otherwise.

Content may not be copied, reproduced, distributed or commercially used without prior written permission, unless permitted by mandatory law.

Article 17 – Privacy

Koning Bamboe processes personal data in accordance with its Privacy & Cookie Policy and applicable privacy legislation.

Article 18 – Disputes and Applicable Law

Agreements between Koning Bamboe and the consumer to which these General Terms and Conditions relate are governed by Dutch law, without prejudice to any mandatory consumer protection provisions that apply in the country where the consumer resides.

Any disputes will, where possible, first be resolved through consultation between the consumer and Koning Bamboe.

If a dispute cannot be resolved amicably, the competent court will be determined in accordance with applicable law.

Article 19 – Changes to the General Terms and Conditions

Koning Bamboe may amend these General Terms and Conditions from time to time.

Changes will not affect agreements that have already been concluded, unless the law provides otherwise.
